The Agreements between us comprise these Terms, any additional terms agreed to by both parties as discussed in the Entire Agreement section, and any other third-party terms, except those excluded (collectively "Agreements"). These Agreements include provisions concerning changes to the Agreements, privacy policy, copyright infringement complaint process, disclaimers on mobile applications, limitations of liability, privacy, waiver of class actions, and arbitration to resolve disputes instead of a court. Acknowledge reading and comprehending the Agreements, accept them, and consent to be bound by them. If not in agreement with (or unable to comply with) the Agreements, then no access and/or utilization of Purple Smart Tv Products and services is allowed. To use Purple Smart Tv Products and Services and access any Content, you must be 18 years or older or be 13 and have your parent/guardian's permission to the Agreements. You must also be able to enter a binding contract with us and not be restricted under any applicable laws. Additionally, you promise that any registration information you submit to Purple Smart Tv is accurate and complete, and you will notify Purple Smart Tv of any changes.

Occasionally, we may modify the Agreements. When we make significant changes, we may notify you using appropriate methods, such as displaying a notification on the Purple Smart Tv or sending you an email. In certain cases, we will alert you ahead of time, and your continued use of the Purple Smart Tv after the changes have been made signifies your consent to the changes. Be sure to read any such notification carefully. If you do not wish to continue using our Application under the new version of the Agreements, you may terminate your account by contacting us. Our Purple Smart Tv reserves the right to modify its subscription fees at any given time. To ensure fairness and transparency, any changes to the Subscription plan will only become effective at the end of the current Billing Cycle. We will give you advance notice of any changes to the subscription fees, so you can terminate your Subscription before the change takes effect. If you choose to continue with Purple Smart Tv service after the subscription fee has been modified, it will be taken as your acceptance of the new fee. A portion of the subscription fee may become payable immediately after the modification. Purple Smart Tv App reserves the right to grant or refuse a case-by-case refund. Lastly, No refunds on any subscriptions. All subscription sales are final.

Our IPTV App offers a 24-hour Free Subscription for a trial and can increase or reduce the Free Trial time duration at its own discretion. You need to enter your billing information in order to sign up for the Free Trial. If you do not enter your billing information when signing up for the Free Trial, you shall not be charged by IPTV App until the Free Trial has expired. At any given time, IPTV App reserves the right to modify the terms and conditions of the Free Trial or cancellation of such Free Trial offer.

When you create an account with us, you have to ensure that you provide information in the best interest and that is accurate, complete, and remains updated at all times. If the provided information is found to be given with malicious intention and fraud then the contract shall stand void ab initio or void. This shall result in an immediate termination of your account and you shall be strictly liable to compensate for the loss or damage. In case of password disclosure to any third party, you shall need to first notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. You shall not use the name of another person as a username or password that is lawfully unavailable to you.

Purple Smart TV is committed to ensuring that the Purple Smart TV application remains operational. However, occasional technical difficulties, maintenance or testing, or updates to comply with relevant laws and regulations may cause temporary interruptions. Please note that Purple Smart TV may modify or discontinue certain functions and features of the application periodically and at any time, with advance notice when possible. This will be done without any liability to you, except where prohibited by law, for any interruption, modification, or discontinuation of the Purple Smart TV application or any of its features.

The Company acknowledges that the accuracy of data and other information provided through the Software cannot be guaranteed, nor can it be guaranteed that such data and information will comply with applicable copyright laws - with the exception of data and information that are directly created or prepared by the Company.

2. The Company is not responsible for any losses or damage incurred to the user due to the installation, use, or non-use of the Software except where such losses or damages are caused by the willful misconduct or gross negligence of the Company.

3. The Company is not responsible for any loss of actual or anticipated profits of the user from their use of the Software.

4. The Company is not responsible for disputes between users or with third parties related to the use of the Purple Smart TV Application. The Company is not liable for any consequences resulting from such disputes. Users should avoid activities that may cause disputes and resolve them according to the law.

By utilizing the cloud recording feature within the Purple apps, you acknowledge that you have read, understood, and agree to abide by these specific terms related to the cloud recording service.

Limitation of Liability

Purple shall not be liable for any loss of recorded content, including but not limited to data corruption, loss due to service outages, or any other claims arising from the use of the cloud recording feature.

Modifications to Terms

Purple reserves the right to modify these terms at any time. Continued use of the cloud recording feature will constitute your acceptance of the modified terms. You will be notified of significant changes via appropriate means.

The Purple Smart TV Application falls under the purview of U.S. export and re-export control laws and regulations, as well as similar laws applicable in other jurisdictions. This includes the Export Administration Regulations (EAR) maintained by the U.S. Department of Commerce, trade and economic sanctions maintained by the Treasury Department's Office of Foreign Assets Control (OFAC), and the International Traffic in Arms Regulations (ITAR) maintained by the Department of State. Please note that it is your responsibility to ensure that you are not located in any country to which the United States has embargoed goods or has otherwise applied any economic sanctions. Additionally, you must not be a denied party as specified in any applicable export or re-export laws or regulations, or similar laws applicable in other jurisdictions. It is imperative that you adhere to all relevant export and re-export control laws and regulations, including but not limited to the EAR, trade and economic sanctions maintained by OFAC, and the ITAR. By accepting the Agreements, you are expressly agreeing that you will not, under any circumstances, directly or indirectly, sell, export, re-export, transfer, divert, or dispose of the Purple Smart Tv Application (including any products derived from or based on such technology) to any destination, entity, or individual prohibited by applicable laws or regulations of the United States or any other jurisdiction. Prior authorization from competent government authorities is required by law before any such action can be taken. Failure to comply with these laws and regulations could result in serious legal consequences.

The Agreements between you and Purple Smart Tv shall remain in effect until either party terminates them. You hereby acknowledge and agree that the perpetual license granted by you in relation to Feedback is irrevocable, and therefore, it will continue after the expiry or termination of the Agreements for any reason. Purple Smart Tv reserves the right to terminate the Agreements or suspend your access to the Purple Smart Tv Application at any time, including in the event of your actual or suspected unauthorized use of the Application or non-compliance with the Agreements. In case we withdraw access to the Application, we shall provide you with reasonable notice in advance. Please note that we shall take all necessary measures to enforce our rights in case of breach of the Agreements. In the event of termination by either party or suspension initiated by Purple Smat Tv of your access to the Purple Smart Tv Application, you acknowledge and agree that Purple Smart Tv shall not be held liable or responsible for any damages or losses incurred by you. Furthermore, you also acknowledge and agree that Purple Smart Tv will not provide any refunds for any amounts that you have already paid, to the fullest extent permitted by applicable law. You don't retain the right to terminate the Agreements at any time. Please note that this section will be enforced in accordance with applicable law.

Please be advised that by using the Purple Smart Tv application, you hereby acknowledge and agree that the application is provided "as is" and "as available," without any express or implied warranty or condition of any kind. Purple Smart Tv, as well as all owners of the content, shall not be held liable for any representations made or warranties or conditions of satisfactory quality, merchantability, fitness for a particular purpose, or non-infringement. It is important to note that Purple Smart Tv does not provide any warranty that the application is free of malware or other harmful components. Therefore, it is imperative that you use the application at your own risk and take necessary precautions to ensure the safety of your device. Thank you for your understanding in this matter. In addition, it must be stated that Purple Smart Tv provides no representation and does not warrant, endorse, guarantee, or assume responsibility for any third-party applications or the content thereof, user content, devices, or any other product or service advertised, promoted, or offered by a third party on or through the Purple Smart Tv application. Purple Smart Tv is not responsible or liable for any transaction between you and third-party providers of the aforementioned. It is important to note that no advice or information, whether oral or in writing, obtained by you from Purple Smart Tv shall create any warranty on behalf of the company. By using the IPTV Purple Smart TV application, you acknowledge that your only recourse for any issues or dissatisfaction with the app is to uninstall it and discontinue its use. Purple Smart TV is not responsible for any third-party applications or their content that you may access through or in connection with the app, and any relationship you have with such third-party applications is governed by separate agreements with those parties. If you experience any problems or dissatisfaction with third-party applications or their content, your sole and exclusive remedy is to uninstall and/or stop using those applications. Purple Smart Tv, its officers, employees, agents, directors, subsidiaries, affiliates, successors, assigns, suppliers, or licensors shall not be held liable for any indirect, special, incidental, punitive, exemplary, or consequential damages. This includes any loss of use, data, business, or profits (whether direct or indirect), arising from the use of or inability to use the Purple Smart Tv application, devices third-party applications, or third-party application content. This applies regardless of legal theory and even if Purple Smart Tv has been warned of the possibility of such damages. Furthermore, if a remedy fails its essential purpose, Purple Smart Tv shall not be held liable. The aggregate liability for all claims relating to the Purple Smart Tv application, third-party applications, or third-party application content shall not exceed the amounts paid by you to Purple Smart Tv during the prior twelve months in question.

Attention Users who have downloaded the App from the Apple, Inc. ("Apple") App Store or using the App on an iOS device! Please be advised that this Agreement is exclusively between you and Purple Smart Tv and Apple shall not be held responsible for the Application and its content. Furthermore, Apple is under no obligation whatsoever to provide maintenance or support services for the Application. In the unlikely event that the Application fails to comply with any applicable warranty, you may notify Apple and they will refund any purchase price for the App. However, in accordance with applicable laws, Apple has no other warranty obligation whatsoever with respect to the Application. Please take heed of this legal notice to ensure a smooth and informed user experience. Apple cannot be held responsible for any claims made by you or any third party regarding the Application or its use. This includes product liability claims, claims of non-compliance with legal or regulatory requirements, and claims arising from consumer protection or similar legislation. Additionally, Apple is not responsible for investigating, defending, settling, or discharging any third-party claims that the Application infringes on their intellectual property rights. Please note that you must comply with any applicable third-party terms when using the Application. Apple and its subsidiaries are considered third-party beneficiaries of this Agreement, and upon your acceptance of this Agreement, Apple will have the right (and be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary. Apple will not be held responsible for addressing any claims made by you or any third party related to the Application or your use and possession of it. Such claims may include product liability claims, claims of non-conformance to legal or regulatory requirements, or claims arising under consumer protection legislation. Additionally, Apple will not be responsible for investigating, defending, settling, or discharging any third-party claims of intellectual property infringement related to the Application or your use and possession of it. As a user of the Application, you agree to comply with any applicable third-party terms. Apple and its subsidiaries are third-party beneficiaries of this Agreement. Upon accepting this Agreement, you acknowledge that Apple has the right to enforce the terms of this Agreement against you as a third-party beneficiary.

When accessing the Site or using the IPTV service, you shall agree to respect the intellectual property right of others. You shall agree to abide by the laws regarding copyright ownership and use of the intellectual property and shall be solely responsible for any violations of laws and infringement of third-party rights. The burden of proving that any content on our service does not violate any laws or third-party rights rests solely with you. You agree to not download, perform, upload, transmit, or distribute any information or content in violation of a third party's copyrights, trademarks, or any other intellectual property rights.

In the event of any non-compliance with the Agreements or any provision thereof, Purple Smart Tv or any third-party beneficiary reserves their right to enforce the same, and any failure to do so shall not be deemed a waiver of their rights. The provisions contained herein are binding and enforceable, and any violation of the same shall result in appropriate legal action.

In the event of any default by Purple Smart TV or any third-party beneficiary in enforcing the Agreements or any of its provisions, it shall not prejudice the right of Purple Smart TV or the relevant third-party beneficiary to subsequently enforce such provision(s). It is imperative to note that the Agreements and its provisions shall remain binding and enforceable to the fullest extent permitted.

As used in these Terms, the words “include” and “including,” and variations thereof, will be deemed to be followed by the words “without limitation.”
