Purple Smart TV (ALL APPS) ("we," "us," or "our") respects the intellectual property rights of others and expects its users to do the same. In compliance with the Digital Millennium Copyright Act of 1998 (DMCA), we are committed to addressing claims of copyright infringement in connection with our apps and services. This policy provides guidelines for submitting notifications of infringement, counter-notifications, and responsibilities under copyright law.
If you believe that content available through Purple Smart TV's Apps and Services infringes your copyright, you may submit a Notification of Claimed Infringement (DMCA takedown notice), and we will take appropriate action, which may include removing or disabling access to the allegedly infringing material.
If you are the owner of copyrighted material, or an agent authorized to act on behalf of one, and believe that content available via Purple Smart TV apps and services infringes upon your copyright, you may file a DMCA notification by providing the following information:
To ensure that we can process your notice, it must include the following details—as required under 17 U.S.C. § 512(c)(3)
- Identification of the Copyrighted Work Clearly specify the copyrighted work or works you claim have been infringed. If your notice applies to multiple copyrighted works on our apps or services, a representative list may be provided.
- Identification of the Infringing Material Provide sufficient details to identify the allegedly infringing material that should be removed or access disabled. This may include specific links (URL), item names, or descriptions of where the material can be found within our apps or services.
- Contact Information Include your name, mailing address, telephone number, and email address so that we can contact you if necessary.
- Statements Required by the DMCA
- A statement under penalty of perjury that you have a good faith belief that the use of the material is unauthorized by the copyright owner, its agent, or the law. For example: "I hereby state that I have a good faith belief that the use of the material identified is not authorized by the copyright owner, its agent, or the law."
- A statement that the information in the notification is accurate and, under penalty of perjury, that you are the owner or authorized to act on behalf of the owner of the copyright allegedly infringed. For example: "I hereby state that the information in this notice is accurate, and under penalty of perjury, I am the owner or an authorized agent of the owner of the copyright that is being infringed."
- Your Signature Include your physical or electronic signature (typing your legal name constitutes an electronic signature).
You can submit your DMCA Takedown Notice to our Designated Copyright Agent at the following email address

Inaccurate, incomplete, or invalid notices may delay or prevent us from handling your claim. For this reason, we recommend consulting with your legal advisor to ensure compliance with DMCA requirements.
Upon receipt of a valid DMCA notification:
- Review of the Notification We will review the submitted notice to ensure all required elements have been provided in accordance with the DMCA.
- Removal or Disabling Access If the notification is valid, we will promptly remove or disable access to the allegedly infringing material.
- Notifying the User The user responsible for the upload or content in question will be notified of the takedown, along with instructions on how to submit a Counter Notification if they believe the material was removed in error.
- Repeat Infringers Purple Smart TV maintains a strict Repeat Infringer Policy. Users who are repeatedly found to engage in infringing activity will have their accounts terminated or otherwise restricted at our sole discretion.
If you believe that the material was removed or disabled by mistake or misidentification, you may submit a Counter Notification under the DMCA. To be effective, your Counter Notification must include the following information:
- Identification of the Material Identify the material that was removed or disabled and include a description or location (such as the URL or name) where the material appeared prior to its removal.
- Your Contact Information Include your name, address, phone number, and email address.
- Statements Required by the DMCA
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which you reside (or, if you are located outside of the United States, the jurisdiction of Winter Park, FL).
- A statement that you will accept service of process from the person who filed the original DMCA notification or an authorized agent of such person.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification. For example: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed."
- Your Signature Provide your physical or electronic signature (your typed legal name is acceptable as an electronic signature).
Counter Notifications must be submitted to our Designated Copyright Agent via email:
Email: [email protected]
- Forward Counter Notification Upon receiving a valid counter-notification, we will forward it to the original claimant who submitted the takedown notice.
- Waiting Period The original claimant will have 15 to 20 business days to notify us that they have filed a court action to prevent the allegedly infringing party from engaging in the activity in question.
- Restoration of Removed Content If no such notification is received within 20 business days, we may restore the removed or disabled material.
In accordance with the DMCA, Purple Smart TV has a policy for terminating accounts of repeat infringers under appropriate circumstances and at our discretion. If a user is found to repeatedly infringe copyrights, their account will be suspended or permanently disabled.
Submitting false claims or counter-notifications is a violation of the DMCA and may result in legal liability. Under Section 512(f) of the DMCA, any person who knowingly submits false or materially misleading information in a notification or counter-notification may be held responsible for damages, including costs and attorney’s fees.
We encourage all parties to consult legal advice before submitting DMCA notifications or counter-notifications to ensure compliance with applicable laws.
