Purple Smart TV (ALL APPS) ("we," "us," or "our") respects the intellectual property rights of others and expects its users to do the same. In compliance with the Digital Millennium Copyright Act of 1998 (DMCA), we are committed to addressing claims of copyright infringement in connection with our apps and services. 2. Purple Smart TV's Response to Notifications

Upon receipt of a valid DMCA notification:

  1. Review of the Notification We will review the submitted notice to ensure all required elements have been provided in accordance with the DMCA.
  2. Removal or Disabling Access If the notification is valid, we will promptly remove or disable access to the allegedly infringing material.
  3. Notifying the User The user responsible for the upload or content in question will be notified of the takedown, along with instructions on how to submit a Counter Notification if they believe the material was removed in error.
  4. Repeat Infringers Purple Smart TV maintains a strict Repeat Infringer Policy. Users who are repeatedly found to engage in infringing activity will have their accounts terminated or otherwise restricted at our sole discretion.

3. Filing a DMCA Counter Notification

If you believe that the material was removed or disabled by mistake or misidentification, you may submit a Counter Notification under the DMCA. To be effective, your Counter Notification must include the following information:

  1. Identification of the Material Identify the material that was removed or disabled and include a description or location (such as the URL or name) where the material appeared prior to its removal.
  2. Your Contact Information Include your name, address, phone number, and email address.
  3. Statements Required by the DMCA
    • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which you reside (or, if you are located outside of the United States, the jurisdiction of Winter Park, FL).
    • A statement that you will accept service of process from the person who filed the original DMCA notification or an authorized agent of such person.
    • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification. For example: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed."
  4. Your Signature Provide your physical or electronic signature (your typed legal name is acceptable as an electronic signature).

4. Handling of Counter Notifications

  1. Forward Counter Notification Upon receiving a valid counter-notification, we will forward it to the original claimant who submitted the takedown notice.
  2. Waiting Period The original claimant will have 15 to 20 business days to notify us that they have filed a court action to prevent the allegedly infringing party from engaging in the activity in question.
  3. Restoration of Removed Content If no such notification is received within 20 business days, we may restore the removed or disabled material.

5. Repeat Infringer Policy

In accordance with the DMCA, Purple Smart TV has a policy for terminating accounts of repeat infringers under appropriate circumstances and at our discretion. If a user is found to repeatedly infringe copyrights, their account will be suspended or permanently disabled.

6. False Claims and Misrepresentation

Submitting false claims or counter-notifications is a violation of the DMCA and may result in legal liability. Under Section 512(f) of the DMCA, any person who knowingly submits false or materially misleading information in a notification or counter-notification may be held responsible for damages, including costs and attorney’s fees.

The content accessed through Purple Smart TV (ALL APPS) is entirely determined, controlled, and managed by the users themselves.

Purple Smart TV (ALL APPS) has no ownership, authority, or involvement over the content input by users or any third-party sources linked to its platforms. These apps act strictly as players or interfaces and do not endorse, monitor, modify, or manage any media, playlists, or streams selected or provided by users for playback.

It is the sole responsibility of the user to ensure that the content accessed, viewed, or streamed through Purple Smart TV (ALL APPS) complies fully with applicable copyright laws, regulations, and permissions. Purple Smart TV (ALL APPS) expressly disclaims any liability for infringing content accessed or used through its applications, as the company does not host or facilitate the provision of such content.
